Définition

The Law of 9 July 1991, which came into force on 1st January 1993, reformed civil enforcement procedures and established the enforcement judge.

The judge handles disputes revolving around the enforcement of judgements or of any other judicial or administrative decisions. At the same time, the powers held previously by the trial judge regarding the over-indebtedness of private individuals were also transferred to the enforcement judge.

The function of enforcement judge belongs to the president of the court of first instance, who may delegate it to one or more judges.
